The Home Office announced in September that people applying for settlement as a Bereaved Partner, following the death of their partner, will now be able to apply for a fee waiver to avoid the £2,885 fee.
An applicant can apply for settlement immediately after the death of their partner if they were in the UK as a partner of one of the following:
- British citizen
- Person with indefinite leave to remain in the UK
- EU citizen with pre-settled status
- Member of HM Armed Forces, Gurkha or Hong Kong military unit veteran who was discharged before 1 July 1997
To qualify for a fee waiver, the applicant must show that they cannot afford the application fee. There is no longer a requirement to prove destitution.
Fee waivers can be complex applications that require a lot of evidence. Contact our friendly team today if you would like advice or assistance with this application.
