Defined Certificate of Sponsorship made by sponsors from the care sector and the Hospitality sectors are now subject to close scrutiny. Yukino Posthuma de Boer from the Business and Skilled Immigration team explores this topic her Q&A below.
Sponsors in the care sector: why is my defined CoS application taking so long?
Applications for a Defined Certificate of Sponsorship made by care providers are now subject to close scrutiny. We are receiving an increasing number of enquiries from sponsors in the care sector urgently seeking to hire carers from outside the UK.
What is a Defined Certificate of Sponsorship (DCoS)?
A DCoS is an electronic document with a unique reference number issued by a sponsor to a worker who applies for entry clearance. It confirms the details of the job for which they will be sponsoring the worker.
What is the genuine vacancy requirement?
To sponsor a Skilled Worker, regardless of the job role, a sponsor must be able to offer genuine employment that meets the requirements of the Skilled Worker route. In other words, the job they offer exists and has not been created for the worker.
This will be assessed by the Administration Officer who performs the genuine employment checks. Further information may be requested if they consider it necessary.
What must be included in a DCoS application?
To pass the genuine employment checks, it is important that all the information required by the Home Office guidance is included.
What is a further information request?
The Home Office has started to ask for substantial additional information. When further information is requested, the sponsor is normally given only 5 working days to respond.
How we can help you
Dealing with the Home Office’s additional information request is time-consuming and stressful. Please contact our friendly team today for more information.
